Definitions of collateral source

  • US the collateral source rule/doctrine states that evidence that a victim’s damages were or will be compensated from a source other than the damages awarded against the Defendant (eg by an insurance company) cannot be admitted during a trial

    If evidence of a collateral source is admitted, a jury may reduce the award to compensate for the already-paid damages.
