the ability, power, or legal right to take a civil legal action against a person or organisation, often (but not only) when claiming money for some harm, injury or wrong that they have caused you. A person's capacity to sue is determined by legal status, age, and mental capacity etc.
The department lacks the capacity to sue or be sued under Kansas law.
