where something left in a will cannot be given to a beneficiary because the thing left no longer exists. The common law doctrine of ademption deals with the cancellation of a gift left in a will that is no longer owned by the gift-giver at the time of their death.
Because the property had been sold during the decedent’s lifetime, the ademption doctrine extinguished any breach of fiduciary duty.
